Terms of Service
These Terms of Service ("Terms") govern your access to and use of trysupers.com (the "Site"), any related mobile or social storefronts, and the purchase of products offered by Supers ("Supers," "we," "us," or "our"). By visiting the Site, creating an account, or purchasing from us, you agree to these Terms and to the policies incorporated by reference, including our Privacy Policy, Refund & Money-Back Policy, and Shipping Policy. If you do not agree, do not use the Site or purchase our products.
Our store is hosted on Shopify Inc., which provides the e-commerce platform we use to sell products. Supplemental terms presented at checkout (including subscription disclosures) form part of these Terms.
1. Eligibility and Acceptable Use
You represent that you are at least the age of majority where you reside, or that you have given consent for any minor dependents in your care to use the Site under your supervision. You will use the Site and products only for lawful purposes, will not violate applicable laws (including intellectual-property laws), and will not transmit malicious code, engage in scraping or bulk harvesting, attempt to bypass security features, or interfere with Site operation. A breach of these Terms may result in immediate termination of access.
2. General Conditions
We may refuse service, limit quantities, or cancel orders at our discretion, including orders that appear to be placed by resellers or distributors, orders using the same account, payment method, or address in a manner that suggests fraud or abuse, and orders for delivery outside our service area. Content you submit through the Site (other than payment-card data, which is encrypted in transit) may traverse multiple networks and be adapted for technical requirements. You may not reproduce, copy, sell, or exploit any portion of the Site or its content without our prior written permission. Headings are for convenience only.
3. Accuracy of Information; Changes to Site and Prices
We aim for accuracy but do not warrant that Site content is complete, current, or error-free. Product descriptions, pricing, promotions, shipping charges, and availability may contain errors and may be corrected at any time, including after you place an order. Prices and product assortments may change or be discontinued without notice. Reliance on Site material is at your own risk; consult primary sources for decisions that affect your health.
4. Products; Supplement-Specific Terms
Certain products may be available exclusively online and in limited quantities, and are subject to our Refund & Money-Back Policy. Colors and packaging shown online may differ slightly from what you receive due to display settings and manufacturing variation.
Dietary supplement statements.
Our products are dietary supplements. Statements about structure or function have not been evaluated by the U.S. Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease. Content on the Site is for general information only and is not medical advice. Consult your physician before using any supplement, especially if you are pregnant, nursing, taking medication (including GLP-1 medications, antidepressants, anticoagulants, or stimulants), or have a medical condition. Discontinue use and consult a physician if adverse reactions occur. Individual results vary and are not guaranteed.
You agree not to use our products for any unlawful purpose and to follow label directions. Keep out of reach of children. Do not exceed the suggested serving.
5. Subscription Terms (Recurring Billing) — Please Read Carefully
Summary of your subscription.
When you select a subscription, you enroll in an auto-renewing program. Unless you pause, skip, or cancel before the renewal date shown in your account, we will charge the payment method on file and ship a new supply on the schedule you selected.
Cadence:
Every 4 weeks (28 days) unless you choose a different frequency at checkout or in your account portal.
Price:
The recurring charge currently displayed at checkout is $49.13 every 4 weeks, plus applicable taxes and shipping. A first-order promotional price (for example, $29.48 for the first shipment after an applied introductory discount) applies only to the first order and does not change the recurring price. The exact recurring amount, frequency, and next charge date are shown at checkout and in your confirmation email and account portal.
Consent:
By completing a subscription checkout, you expressly consent to recurring charges on these terms until you cancel. We will send a confirmation email after your initial subscription order and advance reminders as required by law and by our payment processor.
Manage or cancel anytime:
You may pause, skip a shipment, change flavor or quantity, update payment or shipping details, or cancel at any time in your account portal at trysupers.com/account or by contacting Hello@trysupers.com. Cancellation stops future shipments and charges; it does not retroactively refund shipments already processed or delivered, except as provided in our Refund & Money-Back Policy.
Price or term changes:
If we change the recurring price, frequency, or material terms, we will provide advance notice by email and in the account portal and will obtain your consent where required by law. Continued subscription after the effective date of a disclosed change constitutes acceptance.
Failed payments:
If a charge fails, we may retry it, contact you to update payment details, pause shipments, or cancel the subscription.
No cancellation by returned product:
Sending product back without following our returns process does not cancel your subscription. Please cancel in the portal or by contacting support, and separately request any refund under our Refund & Money-Back Policy.
6. Billing and Account Information
You agree to provide current, complete, and accurate billing, shipping, and contact information and to keep it updated so we can fulfill orders and reach you about your account. We may attempt to notify you of order changes using the email, phone, or address you provided. You are responsible for charges incurred under your account.
7. Optional Tools and Third-Party Links
We may offer access to third-party tools, content, or linked websites "as is" without warranties or endorsement. Your use of third-party tools or sites is at your own risk and subject to those third parties' terms and privacy practices. Questions or complaints about third-party products should be directed to the third party.
8. User Content, Reviews, and Submissions
If you submit reviews, comments, photos, ideas, or other content (collectively, "Comments"), you grant us a non-exclusive, worldwide, royalty-free right to use, reproduce, edit, publish, and distribute those Comments in any medium for operating and promoting the Site, without obligation to keep them confidential, pay compensation, or respond. You represent that your Comments do not infringe any third-party rights, contain unlawful, defamatory, abusive, or obscene material, or include malware or false return addresses. We may monitor, edit, or remove Comments at our discretion but have no obligation to do so. Health-related testimonials reflect individual experiences, are not medical claims, and should not be read as a promise of results.
9. Personal Information
Your submission of personal information through the Site is governed by our Privacy Policy. By using the Site, you consent to the practices described there.
10. Prohibited Uses
In addition to other prohibitions in these Terms, you may not use the Site to: (a) engage in unlawful conduct; (b) solicit unlawful acts; (c) violate federal, state, or local laws; (d) infringe intellectual-property or privacy rights; (e) harass, defame, or discriminate; (f) submit false or misleading information; (g) upload viruses or malicious code; (h) collect others' personal information without consent; (i) spam, phish, scrape, or crawl in a manner that burdens the Site; (j) engage in obscene or immoral conduct; or (k) interfere with security features. We may terminate access for violations.
11. Disclaimer of Warranties; Limitation of Liability
THE SITE AND ALL PRODUCTS AND SERVICES DELIVERED THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. WE DO NOT WARRANT UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE OPERATION, OR THAT RESULTS FROM USE OF THE SITE OR PRODUCTS WILL MEET YOUR EXPECTATIONS.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL Supers, ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM AN ORDER WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE JURISDICTIONS, LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
Nothing in these Terms limits liability that cannot be limited by law, including for fraud or willful misconduct.
12. Indemnification
You agree to indemnify and hold harmless Supers and its officers, directors, employees, affiliates, agents, and suppliers from claims, damages, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your misuse of the Site or products, or your violation of any law or third-party right.
13. Severability; Waiver; Entire Agreement
If any provision of these Terms is held unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will continue in full effect. Our failure to enforce any right is not a waiver of that right. These Terms, together with the incorporated policies and any checkout disclosures, are the entire agreement between you and us regarding the Site and supersede prior oral or written understandings on the same subject.
14. Termination
These Terms remain effective until terminated by either party. You may stop using the Site at any time. We may suspend or terminate access, accounts, or subscriptions for breach of these Terms or for operational, legal, or security reasons, with notice where reasonably practicable. Obligations incurred before termination (including payment and Sections 11–13 and 15) survive termination.
15. Governing Law; Disputes
These Terms and any separate agreements under which we provide services are governed by the laws of Hong Kong, without regard to conflict-of-law principles. You consent to the exclusive jurisdiction and venue of the courts of Hong Kong, except where applicable consumer-protection law gives you the right to bring a claim in your home jurisdiction. Before filing suit, you agree to contact us at Hello@trysupers.com and attempt in good faith to resolve the dispute for 30 days. Nothing in this section limits any non-waivable consumer rights.
16. Changes to These Terms
We may update these Terms by posting a revised version on this page and updating the "Last Updated" date. Material changes will be highlighted or communicated by email or Site notice where required by law. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
